Book Presentation: "Composizione Assistita della Crisi"
Gianfranco Di Garbo and Maurizio Irrera of Interconsulting Milan, a member firm of Pragma, were speakers at a seminar organized by Centro Convegni Borgogna in Milan on February 21, 2022, in connection with the presentation of a book of Maurizio Irrera dealing with the new Corporate debtor insolvency code, which provides for alternative proposal for aided composition of the crises of companies (“composizione assistita della crisi”) .
The new law (Legislative Decree No. 14 of 2019) will became into force in May ,15, 2022 and provides, inter alia, that the figure of the bankrupt disappears and is replaced by the judicial liquidation procedure, but gives priority to proposal which are alternative to the judicial liquidation and to a court settlement with creditor (“concordato”), by setting a procedure aimed at protecting the debtor and the creditors, limiting to the extent possible all actions which may prejudice their interest, and looking for a solution that may possibly maintain the activity of the company and the consequent employment of worker.
