New Law on Computer Crimes

On June 20, 2022, the new Law on Computer Crimes (Law No. 21,459), which replaces the old Law No. 19,223, was published in the Official Gazette. The new law expands the catalog of crimes, classifying as sanctioned conduct attacks on the integrity of a computer system or its data, illegal access and interception, computer forgery, receipt of computer data, computer fraud and abuse of devices.

On the other hand, as of December 20, 2022, the crimes of the new law will be those that may give rise to the criminal liability of the legal entity (if they are committed in its interest or for its benefit) and the commission of the crime of money laundering.

For this reason, the new Law on Computer Crimes becomes an excellent opportunity for companies to evaluate their internal processes for obtaining, storing and transferring data, and to implement or update a crime prevention system. With the publication of the new Law on Computer Crimes, it becomes more important than ever for companies to control the origin of the data they store.
