Legal Labor Note on a 4-day Working Day
On April 13, the call for aid from the Ministry of Industry for SMEs was published in the Official State Gazette (BOE) in order to implement the 4-day session.
Specifically, an Extract from the Resolution of April 11, 2023, of the EOI Foundation, FSP, was published, approving the call for the granting of aid aimed at promoting the improvement of productivity in small and medium-sized industrial companies.
Beneficiaries.
Companies that are considered small and medium-sized industrial companies with less than 250 workers, with their own legal personality, legally constituted in Spain and duly registered in the corresponding registry, may be beneficiaries.
Requirements.
- Companies that decide to take advantage of this subsidized pilot program may be eligible for aid of up to 200,000 euros if they reduce 10% of the full-time working day weekly for a minimum of 24 months without reducing the salaries of their employees.
- The reduction in working hours will affect employees with an indefinite full-time contract at the time the project starts.
- The reduction in working hours will be maintained for 2 years.
- The number of workers participating in the project must affect at least 30% of the workforce in companies with up to 20 workers and 25% in companies with between 21 and 249 workers.
- Additional organizational or training measures must be implemented to optimize working time during the entire duration of the pilot project in order to always improve productivity. Incorporating in turn indicators that measure its evolution.
- Special consideration will be given to the agreement with the legal representation of the workers before making the request for help.
Beneficiary activity sectors.
They must have a minimum of three years of seniority in the industrial sector:
- Production activities on an industrial scale.
- Recovery activities on an industrial scale.
- Complementary activities to industrial production.
- Service activities in the industry.
Assignment of aid.
The aid will be assigned based on the number of employees of the SMEs.
- Companies with up to 10 employees will be subsidized 90% of the personnel cost supported by the company.
- Companies between 11 and 52 workers up to 80% of personnel costs.
- Companies between 53 and 249 workers up to 75% of personnel costs.
Deadline for submission of applications.
The deadline for submitting applications will be one month from the publication of the extract in the BOE (April 13, 2023).
